These Candidate Portal Terms (“Terms”) govern your use of the Delv Global Candidate Portal, Talent Network, candidate-profile tools, video-introduction tools, communications, and related services (collectively, the “Candidate Portal”).
Delv Global LLC (“Delv Global,” “we,” “us,” or “our”) connects growing companies with remote talent from Latin America. By creating an account, accessing the Candidate Portal, or using its features, you agree to these Terms and acknowledge Delv Global’s Privacy Policy.
1. Eligibility and account registration
You must be at least 18 years old and legally able to agree to these Terms to create a Candidate Portal account.
You agree to provide accurate, complete, and current information about yourself, including your name, contact information, professional experience, skills, education, availability, location, time zone, compensation expectations, and other profile details.
You are responsible for keeping your account information current and for protecting your login credentials. Do not share your account with another person or create an account using another person’s identity or information.
2. Delv Global Talent Network
The Candidate Portal allows you to create and manage a professional profile that Delv Global may consider for relevant client opportunities, searches, interviews, and recruiting workflows.
Creating a profile or joining the Talent Network does not guarantee that Delv Global will contact you, share your profile with a client, provide an interview, offer, placement, contract, employment opportunity, or make any particular role, compensation level, schedule, client, or work arrangement available.
Client hiring decisions remain the client’s responsibility.
3. Candidate profile and client sharing
You authorize Delv Global to review, organize, format, host, and share your candidate profile and approved hiring materials with Delv Global personnel, service providers supporting the Candidate Portal, and potential clients or hiring teams when reasonably related to recruiting, candidate evaluation, interview coordination, placement, contractor administration, or related Delv Global services.
Candidate materials may include your professional profile, resume, work history, education, skills, tools, certifications, languages, availability, location or time-zone information, portfolio links, work samples, profile photo, video introduction, and expected compensation.
Delv Global will not share your email address or phone number publicly through your candidate profile. Delv Global’s use of candidate information is also governed by the Privacy Policy.
4. Profile visibility and public profiles
You control your profile visibility through Candidate Portal settings. Visibility options may include hiding your profile, making it available within the Delv Global Talent Network and to potential clients, or making selected professional information publicly available.
If you choose to make your profile public, you acknowledge that your selected professional information, including your expected compensation or target rate, may be viewed by the public and may be indexed by search engines if you enable search indexing.
Your choice to make a profile public is governed by the Public Profile Notice presented in the Candidate Portal. You may make your profile inactive or change its visibility through available account controls.
5. Profile photos, video introductions, and candidate materials
You retain ownership of the content you submit to the Candidate Portal.
By uploading or submitting candidate materials, you grant Delv Global a non-exclusive, worldwide, royalty-free license to host, store, reproduce, format, transcode, display, transmit, and share those materials only as reasonably necessary to operate the Candidate Portal, maintain your profile, present you to potential clients, coordinate hiring workflows, provide Delv Global services, and comply with legal, security, backup, and recordkeeping obligations.
You represent that you have the right to submit your candidate materials and that doing so does not violate another person’s rights, confidentiality obligation, contract, intellectual-property right, or privacy right.
These Terms do not grant Delv Global permission to use your likeness, profile photo, video introduction, or other candidate materials for public advertising, social-media promotion, testimonials, marketing campaigns, or AI-generated promotional images. Those uses require your separate, optional consent through the Talent Showcase & Promotional Media Release.
6. Identity verification
Delv Global may ask you to complete identity verification for certain roles, workflows, interviews, client requirements, safety measures, or fraud-prevention purposes.
Identity verification may involve a third-party provider’s review of a government-issued identification document, a facial image or selfie, face matching, and liveness detection. If identity verification is required for a particular workflow, you will receive a separate Identity Verification Notice and be asked to provide consent before verification begins.
Identity verification is not a background check, credit check, employment-eligibility determination, or guarantee of your qualifications, work performance, or legal right to work.
If you decline a verification required for a particular opportunity or workflow, Delv Global may be unable to advance your profile for that opportunity.
7. Communications
You agree that Delv Global may contact you about your account, profile, opportunities, interviews, verification status, support requests, service updates, and other operational matters by email, phone, text message, portal notification, or other contact methods you provide, subject to applicable law and your communication preferences.
You may opt out of non-essential marketing communications using the unsubscribe instructions provided. You may not opt out of essential account, security, legal, or operational communications while maintaining an active account.
8. Your responsibilities and prohibited conduct
You may not use the Candidate Portal to submit false, misleading, incomplete, fraudulent, or impersonated information; upload content you do not have the right to use; misrepresent your qualifications or identity; interfere with or misuse the Candidate Portal; upload harmful or unlawful content; use another person’s account or likeness; or bypass identity-verification, fraud-prevention, or account-security measures.
Delv Global may suspend, restrict, remove, or terminate an account or content when we reasonably believe these Terms, applicable law, platform security, candidate safety, client safety, or another person’s rights may be affected.
9. Account deactivation and deletion
You may make your profile inactive through available Candidate Portal settings. An inactive profile will no longer be intended for active discovery by potential clients, although information already shared with clients or included in prior hiring workflows may remain in those records.
You may request or initiate deletion of your Candidate Portal profile as described in the Privacy Policy. Deletion removes the active profile record, subject to limited backup, security, legal, fraud-prevention, accounting, dispute-resolution, and compliance exceptions.
10. Delv Global’s role
Delv Global provides recruiting, Talent Network, candidate-profile, interview-coordination, and related services. Unless a separate written agreement expressly says otherwise, Delv Global is not your employer, legal representative, immigration advisor, tax advisor, or guarantor of any client opportunity.
11. Disclaimers
The Candidate Portal and Delv Global services are provided on an “as available” basis. Delv Global does not guarantee uninterrupted access, the availability of any opportunity, the accuracy of client-provided information, a successful placement, or a particular outcome.
12. Changes to these Terms
Delv Global may update these Terms from time to time. The effective date at the top of this page shows when the Terms were last revised.
13. Governing law and venue
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules.
Any dispute arising from these Terms or the Candidate Portal will be brought exclusively in the state or federal courts located in Dallas County, Texas, unless applicable law requires otherwise.
